Terms of Participation

Please read the following points carefully as they contain important information that you need to know and which will apply to your entry.

The promoter of this competition Win your Summer in Dublin is Sagitter Training Dublin, a company located in Dublin, Ireland (the “Promoter”, “us”, “we”).

Information on how to enter and the prizes form part of these conditions of entry (the “Terms of Participation”).

1. Eligibility

• Entry is free and open to adult students aged 18 – 30 years old, residing in Italy.
• You may only enter once and in your own name.
• We may ask you to provide proof of identity, residency, and age to confirm that you are eligible to participate.

2. How to enter
   • To enter, you will need to complete all the fields in the entry form and follow the account of our company (@sagittertraining). You don’t have to buy anything to enter.
   • You can have a double chance to win if you tag the Instagram user of a friend in the giveaway post.
   • You can have a triple chance to win if you upload the giveaway post to your Instagram stories and tag our account (@sagittertraining).
   • By entering, you confirm that all of your entry is your own work. It’s your responsibility to make sure that your entry doesn’t infringe on any third-party rights.

3. Competition period
   • The competition starts on 12.01am GMT May 8, 2023 (“Opening Date”) and closes on 11.59pm GMT May 21, 2023 (“Closing Date”). Your entry is received at the time we receive it.
   • If your entry gets lost in cyberspace or doesn’t arrive for any other reason, you won’t hold us responsible. The winner will be announced on our Social Media account on July 22, 2023, unless the competition end date is extended. The winner will also receive a prize notification email.

4. The prize
   • One prize will be awarded per prize-winner. There will be a total of one (1) prize-winner selected from the applicants.
   • Prize Description: A 2-week English language course + homestay accommodation for one person in Dublin in July 2023. The value of the prize is approximately €2000. The estimated value may differ at the time of awarding the prize.
   • For the prize, you’ll be fully responsible to pay any taxes, fees, and additional costs associated with the prize such as flights, transfers, local transportation, teaching materials, and post-booking changes (other than those expressly included in the prize description).
   • The prizes are not transferable or refundable. The prize, or any unused portion of the prize, can’t be taken as cash.

5. Winner selection
   • One (1) winner will be selected from eligible entries. The entry will be chosen live on the day of the announcement and it will be done with the help of an online software that will randomly choose the winner.
   • The winner will be notified by e-mail or phone in May 23, 2023. Their first names, last names, and city may be published on Sagitter Training’s Facebook, TikTok, website, LinkedIn and Instagram account.
   • If the prize notification email is returned as undeliverable, or if the prize remains unclaimed for seventy-two (72) hours after the prize notification email has been sent, the prize will be forfeited, and an alternate winner will be chosen from all remaining eligible (non-winning) entries. You cannot hold us responsible if you fail to receive the prize notification email due to spam, junk email, or other security settings, or if you have provided incorrect or non-functioning contact information.

6. Intellectual Property
   • By submitting your entry, you understand that the Promoter, anyone acting on behalf of the Promoter, or its respective licensees, successors, and assignees will have the worldwide irrevocable right to review, print, publish, broadcast, distribute, and use, in any media, in perpetuity, your entry, including without limitation, the entry and your name, portrait, picture, voice, likeness, image or information for trade, advertising, public relations and promotional purposes, without any further compensation.
   • By accepting the price, you understand that the Promoter, anyone acting on behalf of the Promoter, or its respective licensees, successors, and assignees will have the permission to ask you for media of your trip for marketing purposes, including pictures, videos, interviews, social media live events or related.

7. Limitation of liability
   • To the maximum extent allowed by law, the promoter will not be held liable for any loss or damage whatsoever suffered (including, but not limited to, indirect or consequential loss) or for any personal injury (including death) suffered or sustained in connection with your participation in the competition and/or related to the prize, except for any liability that cannot be excluded by law (in which case, such liability is limited to the maximum extent permissible by law). The promoter will not be responsible for any incorrect, inaccurate, or incomplete information communicated during or in connection with this competition if the deficiency is caused by any factors beyond the reasonable control of the promoter, including but not limited to technical malfunctions or failures. Tax implications may arise from the receipt or use of a prize. Independent financial advice should be sought.
   • You agree to release and hold harmless the promoter and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the competition and/or your acceptance, possession, use, or misuse of the prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iv) unauthorized human intervention in any part of the entry process or the competition; (v) electronic or human error which may occur in the administration of the competition or the processing of entries.
   • In the event of war, terrorism, state of emergency, disaster, or any other circumstance beyond the control of the promoter, the promoter may cancel, terminate, modify, or suspend the competition.

8. Privacy Policy
   • Any personal information or additional details about you collected by Sagitter Training in connection with the competition is subject to our Privacy Policy. Your personal data, such as your name, phone number and email address, will be processed by Sagitter Training for the purposes of your participation in this competition and to provide you with information and promotions about Sagitter Training and/or any of its affiliates that we believe could be of interest to you.
   • Sagitter Training and its affiliates may use your personal data, combined with information about you obtained from third-party sources, to market our products and services, including special promotions based on your interests. You have the right to withdraw your consent or object to us using your personal data for direct marketing purposes at any time by contacting us at the address [email protected] . We will only retain your personal data for as long as necessary for the purposes for which it was collected, or in accordance with legal time limits and good market practice, unless further retention is required for compliance with a legal obligation or for the establishment, exercise, or defense of legal claims.
   • If you are fortunate enough to be selected as the winner, you agree that your details may be used for publicity purposes, including blogging on Sagitter Training’s preferred social media platforms before, during, and/or after the trip prize. The winner may be asked to complete a report and participate in an interview with Sagitter Training staff upon their return. The winner may also be asked to create blog articles, images, and videos from their trip. The content produced may be used on the campaign website and other advertising channels owned by Sagitter Training.
   • If you would like a copy of the information Sagitter Training holds about you, a copy of the standard data protection clauses, or if you would like to rectify or erase personal data, restrict the processing of personal data, object to our processing, or exercise your right to data portability, please contact us by email us.If you would like to lodge a complaint, please contact the supervisory authority in the country where you reside.

9. Governing law and jurisdiction
   • These Terms of Participation, your entry, and the competition are governed by the laws of Ireland, and you agree to submit to the exclusive jurisdiction of the courts of Ireland to resolve any disputes arising out of or in connection with the competition or these Terms of Participation.

10. No waiver
    • Our failure to enforce any provision of these Terms of Participation will not constitute a waiver of that or any other provision, nor will any waiver by us of any breach of these Terms of Participation be deemed to be a waiver of any other breach of these Terms of Participation.

11. Entire Agreement
    • These Terms of Participation and any other terms incorporated by reference constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior agreements and understandings, whether written or oral, concerning the subject matter hereof.

12. Severability
    • If any provision of these Terms of Participation is held to be illegal, invalid or unenforceable under any present or future laws, such provision shall be fully severable, and the remaining provisions shall constitute the parties’ agreement.

13. Headings
    • The headings used in these Terms of Participation are for convenience only and shall not affect the interpretation of the provisions hereof.

14. Amendments
    • We reserve the right to amend these Terms of Participation at any time without prior notice. Any amendments will be effective immediately upon being posted on our Social Media account (@sagittertraining). Your continued participation in the competition following such amendments will represent an agreement by you to be bound by the Terms of Participation, as amended.
